Marquee Surface LLC
Effective date: October 2026
Agreement to These Terms
These Terms and Conditions (the Terms) govern your access to and use of https://www.marqueesurface.com (the Site) and your purchase of products and services from Marquee Surface LLC, a New York limited liability company located at 100 E Sunrise Hwy, Lindenhurst, NY 11757 (Marquee Surface, we, us, or our).
By accessing the Site, creating an account, submitting a Design Inquiry, requesting a quote, or placing an order, you agree to these Terms, our Privacy Policy, and our Shipping & Delivery Policy, which includes the sections on Inspection and Damage Claims, Limited Warranty, and Final Sale and Returns (together, the Policies). If you do not agree, do not use the Site.
You must be at least 18 years old and legally able to enter a binding agreement. If you order on behalf of a company, you confirm that you have authority to bind it.
Service Area
We deliver only to Connecticut, Maryland, Massachusetts, New Jersey, New York, and Pennsylvania (the Service Area). We do not accept orders for delivery outside the Service Area unless we agree in writing. Some products, delivery zones, or order sizes may carry minimum orders or additional charges.
Our Products and Services
Marquee Surface supplies tile, porcelain slabs, stone, flooring, wall panels, outdoor surfaces, bath products, and related construction materials. We may also provide samples, estimates, material takeoffs, Design Inquiries, quotes, visualization tools, and delivery. Products and services may change without notice.
Product Information and Natural Variation
We make reasonable efforts to provide accurate descriptions, dimensions, specifications, availability, pricing, and photographs. Information on the Site may nevertheless contain errors, omissions, or outdated content.
Photographs and digital renderings are for reference only. Colors, textures, veining, patterns, finishes, and proportions may differ because of lighting, photography, screen settings, manufacturing conditions, or the natural characteristics of the material.
Tile, stone, porcelain, wood, and similar materials vary between samples, production runs, dye lots, shade lots, calibers, batches, and individual pieces. Natural materials may contain variations, markings, fissures, or pores that are not defects. A sample shows general appearance only and does not guarantee an exact match with delivered material.
You are responsible for confirming that the product, finish, dimensions, performance characteristics, and installation requirements suit your project before ordering or installing.
Units, Coverage, and Square-Foot Pricing
Products may be sold by the box, piece, slab, panel, linear foot, pallet, or another stated unit. A price shown per square foot is for comparison only. The amount charged is based on the actual unit of sale, unit size, coverage, and quantity ordered, and rounding may cause small differences. Coverage figures are estimates and are affected by layout, grout joints, cuts, breakage, pattern matching, and site conditions.
Estimators, Visualizers, and Material Takeoffs
Calculators, estimators, visualization tools, quantity suggestions, and takeoffs are planning aids only. Results depend on the measurements and selections entered, may be rounded up to the nearest purchasable unit, and may not account for waste, pattern matching, diagonal layouts, breakage, future repairs, or field conditions.
You are responsible for confirming measurements, verifying quantities with your architect, designer, contractor, or installer, allowing for waste and replacement material, and reviewing the final product, quantity, and unit of sale before you pay. These tools are not architectural, engineering, design, or installation services. Marquee Surface is not responsible for shortages, excess material, measurement errors, or differences between a visualization and the finished project.
Design Inquiries and Quotes
A Design Inquiry or quote request submitted through the Site, email, WhatsApp, telephone, or any other channel is a request for information and is not an order. A quote becomes binding only when we issue a final written quote and accept your order under the procedure stated in that quote. Quotes may carry expiration dates, minimum quantities, and conditions on availability, delivery, taxes, and freight. We may revise or withdraw a quote before accepting an order.
Trade pricing and volume discounts, when offered, are subject to approval and to any additional terms stated in the quote.
Orders and Acceptance
Your order is an offer to purchase. An automated confirmation only acknowledges receipt. We accept an order when payment has been received and cleared and we confirm the order for dispatch.
We may accept, reject, limit, hold, or cancel an order when reasonably necessary, including because of product unavailability, incorrect pricing or product information, suspected fraud, failed or reversed payment, delivery limitations, an address outside the Service Area, quantity limits, or inability to verify customer or project information. If we cancel an order after receiving payment, we will refund the amount collected for the canceled portion by the original payment method unless otherwise agreed.
Special orders, made-to-order products, reserved inventory, and specially sourced materials may be governed by additional written terms.
Prices, Payment, and Taxes
- Prices. Prices are in U.S. dollars and exclude applicable taxes, delivery charges, and other order-specific costs unless stated otherwise. Prices and promotions may change without notice.
- Delivery charges. Delivery charges depend on the delivery zone and the size and weight of your order, and are shown in your cart or quote at checkout.
- Payment in full. Payment in full is required before an order is released for dispatch. Accepted methods are ACH, Zelle, wire transfer, PayPal, and Venmo. Card payments are not accepted. We follow the payment instructions on your invoice or checkout, and the order is not accepted until funds have cleared.
- Failed or disputed payments. We may cancel an order, withhold dispatch, or suspend an account if a payment fails, is reversed, or is disputed.
- Credit. Credit or net terms are available only to approved commercial accounts under separate written terms, which control if they conflict with this section.
- Taxes. You are responsible for applicable sales and use taxes. We collect sales tax as required by New York State law. If you are tax exempt, provide a valid exemption certificate before payment.
- Errors. We may correct pricing, calculation, or product-information errors before fulfilling an order. If a correction materially increases the amount due, we will request your approval before proceeding.
Availability and Inventory
All products are subject to availability. A product displayed as in stock does not guarantee that enough inventory remains when your order is reviewed or fulfilled. We may offer a substitute, revised quantity, backorder, or refund when ordered material is unavailable.
Order enough material for the entire project at one time. We cannot guarantee that later purchases will match the original lot, shade, caliber, finish, or production run.
Shipping and Delivery
Delivery is governed by our Shipping & Delivery Policy. Delivery dates are estimates, not guarantees, unless we guarantee a date in a signed writing. Standard delivery does not include installation, unpacking, inside placement, debris removal, or movement beyond the delivery point described in that policy. Additional charges may apply for redelivery, failed delivery, limited access, address changes, waiting time, or special equipment.
Inspection and Damage Claims
Inspect your delivery promptly. Note visible damage or shortages on the delivery receipt before signing, and photograph the shipment, packaging, labels, pallets, and affected material.
You must report damage, shortages, or incorrect products to us within 48 hours after delivery. Claims reported later are not eligible. Do not install material that appears damaged, incorrect, or materially different from what you ordered. Installation constitutes acceptance of visible characteristics and of any defect a reasonable inspection would have revealed. The full claim process is in the Inspection and Damage Claims section of our Shipping & Delivery Policy.
Final Sale and No Returns
All sales are final. We do not accept returns or exchanges, and we do not issue refunds for change of mind, ordering or measurement errors, excess material, or shade preference, except as stated in the Final Sale and Returns and the Limited Warranty sections of our Shipping & Delivery Policy. Nothing in these Terms limits any right you have under applicable law that cannot be waived.
Limited Warranty
Marquee Surface provides a limited warranty covering pieces that are broken or damaged in transport while in our care, on the terms of the Limited Warranty section of our Shipping & Delivery Policy. Except for that limited warranty, we do not provide any other warranty on products, and we do not pass through manufacturer warranties.
Installation and Use
Store, handle, prepare, and install products according to manufacturer instructions, building codes, industry standards, and site requirements. You are responsible for choosing a qualified installer and for determining that the substrate, structure, waterproofing, adhesives, grout, sealers, setting materials, expansion joints, climate conditions, and methods are suitable. Marquee Surface is not the installer and is not responsible for installer workmanship, site conditions, design decisions, code compliance, or failure to follow manufacturer instructions, unless installation is expressly included in a separate signed agreement. Resolve any concern about visible product characteristics before cutting, altering, or installing.
Slabs and Countertops
Slabs and countertop materials are offered through our Design Inquiry process. Slab photographs show general appearance, and each slab varies in veining, pattern, color, and finish. Unless a written quote says otherwise, we do not provide templating, fabrication, or installation. Once a slab is selected, tagged, or paid for, the sale is final.
Accounts and Trade Program
Customer accounts and our Trade Program are coming soon and are not yet active. Additional terms will apply when they launch, and we will post them on the Site.
Reviews and User Content
You keep ownership of reviews, photographs, comments, project images, and other content you submit (User Content). By posting or submitting it, you grant Marquee Surface a non-exclusive, worldwide, royalty-free license to host, reproduce, display, and use it to operate, promote, and improve our business. You confirm you have the rights to submit it and that it does not violate anyone else's rights. We may remove User Content that is unlawful, misleading, abusive, infringing, or otherwise violates these Terms. Private order details and payment information are not User Content.
Intellectual Property
The Site and its text, graphics, photographs, designs, logos, software, and other content are owned by or licensed to Marquee Surface and protected by law. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Site for personal shopping or legitimate internal business purposes. You may not reproduce, sell, republish, scrape, distribute, modify, or commercially exploit Site content without our written permission. Third-party names and trademarks belong to their owners.
Prohibited Uses
You may not use the Site for unlawful, fraudulent, or abusive purposes; provide false information or impersonate another person; interfere with the Site's operation or security; introduce malware; attempt unauthorized access; scrape or systematically extract content; circumvent purchasing limits or security controls; place an unreasonable load on the Site with automated systems; infringe others' rights; or use Site content to build a competing catalog or database. Ordinary use of search engines, browsers, and accessibility tools is permitted.
Third-Party Services
The Site may use or link to third-party services, including BigCommerce, payment providers, carriers, mapping services, WhatsApp, social platforms, and visualization providers. Those services are governed by their own terms and privacy practices. We are not responsible for services we do not control.
Privacy and Communications
Our Privacy Policy describes how we collect and use personal information. By giving us your email or WhatsApp number, you agree that we may contact you about your orders, Design Inquiries, quotes, and deliveries. Marketing messages are sent only as described in the Privacy Policy, and you can opt out at any time.
Site Availability and Corrections
We may modify, suspend, or discontinue any part of the Site when reasonably necessary and do not guarantee that the Site will be uninterrupted, secure, or error-free. We may correct typographical errors, inaccuracies, omissions, product information, availability, and pricing.
Disclaimer of Warranties
THE SITE AND ALL PRODUCTS AND SERVICES ARE PROVIDED ON AN AS IS AND AS AVAILABLE BASIS. EXCEPT FOR THE LIMITED WARRANTY IN OUR SHIPPING & DELIVERY POLICY, MARQUEE SURFACE MAKES NO WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, TO THE FULLEST EXTENT PERMITTED BY LAW.
Some states do not allow certain warranty disclaimers, so some of the above may not apply to you. This section does not limit any warranty or consumer right that cannot be waived under applicable law.
Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, MARQUEE SURFACE AND ITS OWNERS, OFFICERS, EMPLOYEES, AFFILIATES, AND AGENTS ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST BUSINESS, PROJECT DELAYS, INSTALLER OR LABOR COSTS, OR LOSS OF USE, ARISING FROM THE SITE OR AN ORDER. OUR AGGREGATE LIABILITY FOR A PRODUCT OR ORDER IS LIMITED TO THE AMOUNT YOU PAID FOR THE PRODUCT OR PORTION OF THE ORDER GIVING RISE TO THE CLAIM.
These limits do not apply to fraud, willful misconduct, personal injury caused by negligence, statutory product liability, or any liability that law does not allow us to limit.
Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Marquee Surface and its owners, officers, employees, affiliates, and agents from third-party claims arising from your unlawful misuse of the Site, your violation of these Terms, or User Content that infringes another person's rights. This section does not require a consumer to indemnify us for our own negligence, misconduct, or breach.
Suspension and Termination
We may restrict or end access to the Site if you materially violate these Terms, misuse the Site, threaten its security, engage in fraud, or violate the law. Termination does not affect accrued rights or obligations, including payment obligations.
Governing Law and Disputes
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law rules. Before filing a claim, each party will make a good-faith effort to resolve the dispute informally by written notice describing the issue and the requested resolution, and will allow 30 days to respond. Any proceeding must be brought in the state or federal courts located in Suffolk County, New York, and each party consents to their jurisdiction, except where applicable consumer law gives you the right to proceed elsewhere.
To the extent permitted by law, you agree to bring claims only in your individual capacity and not as a plaintiff or class member in any class or representative action.
Changes to These Terms
We may update these Terms and will revise the effective date when we do. Changes apply from the effective date. The Terms in effect when we accepted an order continue to govern that order unless the parties agree otherwise or law requires a different result.
General Provisions
These Terms, the Policies, and any accepted quote or written order agreement are the entire agreement between you and Marquee Surface for the relevant purchase. If a signed quote or order agreement conflicts with these Terms for a particular purchase, the signed document controls for that purchase. If a provision is unenforceable, it is limited only as needed and the rest continues. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent, and we may assign them in a merger, reorganization, or sale of our business. We are not responsible for delay or failure caused by events beyond our reasonable control. Nothing here creates a partnership, joint venture, employment, or agency relationship.
